Initiatives, referenda, amendments, and propositions are on the ballot in several states and localities. Below is a listing of qualified select ballot measures at the state level.

Pennsylvania Proposed Consitutional Amendment - Article III, Section 9 This consitutional amendment would change existing law and increase the power of the General Assembly to unilaterally terminate or extend a disaster emergency declaration. This amendment will also have the effect of reversing a recent ruling of the Pennsylvania Supreme Court which held the Pennsylvania Constitution prohibited the General Assembly from passing a concurrent resolution to terminate the Governor’s Covid-19 disaster emergency declaration without presenting it to the Governor for his approval. 5/18/2021 Passed
Pennsylvania Proposed Constitutional Amendment - Article IV This constitutional amendment would change existing law so that a a disaster emergency declaration will expire automatically after 21 days, regardless of the severity of the emergency, unless the General Assembly takes action to extend the disaster emergency. This amendment would prohibit the Governor from declaring a new disaster emergency to respond to the dangers facing the Commonwealth unless the General Assembly passes a concurrent resolution. 5/18/2021 Passed
Pennsylvania Proposed Constituional Amendment - Article I This consitutional amendment would create a constitutional prohibition against restricting or denying an individual’s equal rights under Pennsylvania law because of race or ethnicity. 5/18/2021 Passed
Colorado Proposition 119 This proposition would increase the marijuana retail sales tax by 5%. It would create the Learning Enrichment and Academic Progress Program and use the additional sales tax revenue to partially fund the program. 11/2/2021 TBD
Maine An Act To Require Legislative Approval of Certain Transmission Lines, Require Legislative Approval of Certain Transmission Lines and Facilities and Other Projects on Public Reserved Lands and Prohibit the Construction of Certain Transmission Lines in the Upper Kennebec Region This initiative would prohibit construction of high-impact electric transmission lines in the Upper Kennebec Region and to require the Legislature to approve all other such projects anywhere in Maine, both retroactively to 2020, and to require the Legislature, retroactively to 2014, to approve by a two-thirds vote such projects using public land. 11/2/2021 TBD
New Jersey Constituional Amendment to Permit Wagering on All College Sport or Athletic Events This constitutional amendment would permit sports wagering at casinos or gambling houses in Atlantic City and at current or former running and harness horse racetracks on the results of any college sport or athletic event that is a tournament, playoff, championship, or other postseason competition that takes place in New Jersey, including any such event in which a New Jersey college team participates, and that is sanctioned by a nonprofit collegiate athletic association led by its members. 11/2/2021 TBD
New Jersey Constituional Amendment to Allow Certain Organizations Authorized to Conduct Games of Chance to Use Proceeds From Those Games to Support the Organization This constitutional amendment would permit all groups that are allowed to conduct bingo or raffles to use the net proceeds from those games to support their groups. 11/2/2021 TBD
New York TBD This constitutional amendment would change the vote thresholds for adopting redistricting plans when one political party controls both legislative chambers. It would codify the requirement that incarcerated persons be counted at the place of their last residence for redistricting. It would require the state to count residents, including people who are residents but not citizens, should the federal census fail to do so. It would remove the block-on-border requirement for Senate districts and codify a cap on the number of State Senators at sixty-three. It would also move up the timeline for redistricting and repeal inoperative language. 11/2/2021 TBD
New York TBD This constitutional amendment would add a right to clean water, clean air, and a healthful environment to the New York Constitution's Bill of Rights. 11/2/2021 TBD
Texas TBD This constitutional amendment would authorize professional sports team charitable foundations of organizations sanctioned by the Professional Rodeo Cowboys Association or the Women’s Professional Rodeo Association to conduct charitable raffles at rodeo venues. 11/2/2021 TBD
Texas TBD This constitutional amendment would change the elibility requirements for justices of the state Supreme Court, judges of the court of criminal appeals, justices of a court of appeals, and district judges. 11/2/2021 TBD
Texas TBD This constitutional amendment would authorize the legislature to provide a homestead property tax exemption for surviving spouses of members of the armed services of the United States who are killed or fatally injured in the line of duty. 11/2/2021 TBD
Texas TBD This constitutional amendment would allow the surviving spouse of a person who is disabled to receive a limitation on the school district ad valorem taxes on the spouse's residence homestead if the spouse is 55 years of age or older at the time of the person's death. The amendment would also refund taxes that exceeding the limit to surviving spouses for the 2020 and 2021 tax years. 11/2/2021 TBD
Louisiana Amendment 1 This constitutional amendment would authorize the legislature to provide funding, duties, and responsibilities of State and Local Streamlined Sales and Use Tax Commission. It would abolishes the Louisiana Sales and Use Tax Commission for Remote Sellers and the Louisiana Uniform Local Sales Tax Board following one year after the first meeting of the commission. It would authorize the legislature to provide for the streamlined electronic filing, electronic remittance, and the collection of sales and use taxes levied within the state by the State and Local Streamlined Sales and Use Tax Commission. 11/13/2021 TBD
Louisiana Amendment 2 This constitutional amendment would lower the maximum allowable rate of individual income tax to 4.75% and authorize the legislature to provide a deducation for federal income taxes paid. 11/13/2021 TBD
