Many states are promulgating rules that will regulate statewide recycling programs for collecting electrical and electronic equipment that contain hazardous substances (RoHS). Specifically, these rules will establish fees in order to create self-sufficient local electronic waste (e-waste) recycling programs, establish statewide e-waste recycling programs, and update existing e-waste rules to comply with federal rules. Other states are drafting amendments that will streamline e-waste management and reclassify e-waste as universal waste.

The Department of Environmental Quality is discussing rulemaking options for amendments to its hazardous waste regulations regarding electronic waste (E-waste). The anticipated regulations will include a recycling program at the state waste district level. Staff report that they are still discussing key program components such as advanced disposal fees, a grants program, and manufacturer take-back programs. Staff report that the ban on e-waste in landfills will likely be January of 2008. The amendments to the regulation will make it consistent with legislation passed in 2007 that allows the disposal of electric lighting devices in landfills if the device contains less than two-tenths milligram per liter of leachable mercury as measured by the Toxicity Characteristic Leaching Procedure as set out in USEPA test method 1131. This language is from Act 512 of 2007.

The Board is proposing to make amendments to the California electronics waste recycling regulations (ewaste rules). In 2003, Electronic Waste Recycling Act (SB 20, Sher) was enacted to establish a funding system for the collection and recycling of electronic waste within California. S.B. 20 required the Board to enact regulations that implemented portions of the statute. The original regulations went into effect in 2006 and now the Board is considering possible updates to those e-waste rules. More specific details on those updates will be determined at a later date.
